Why in News?
Recently, President Droupadi Murmu will administer the oath
of office to the new Chief Justice of India, Justice Dhanajaya Yeshwant
Chandrachud at Rashtrapati Bhawan.
- He succeeded Justice UU Lalit(49th CJI).
- Justice DY Chandrachud is the 50th Chief Justice of India.
About DY Chandrachud:
- He Born in 1959, Mumbai (Maharashtra).
- Justice Chandrachud was appointed Judge of the Supreme Court of India on the 13th of May 2016.
- Earlier, he served as Chief Justice of the Allahabad High Court.
- Education Qualification:
- LLB from Campus Law Centre from Delhi University and
- LLM degree and a Doctorate in Juridical Sciences from Harvard Law School in the USA.
What is the Qualification of the Judge of the Supreme Court & Chief Justice of India (CJI)?
- The CJI should be a citizen of India.
- He should have been a judge of a High Court for five years.
- He should have been an advocate of a High Court for 10 years.
- Be, in the opinion of the President, a distinguished jurist.
Note: The Constitution of India has not prescribed a minimum
age for appointment as a Judge of the Supreme Court.
Appointment of Chief Justice of India (CJI):
- Under the Article 124 of the Constitution the CJI and the Judges of the Supreme Court (SC) are appointed by the President of India.
- The CJI is appointed by the President after the consultation with such judges of the Supreme Court and High Court as he deems necessary
- The senior most judge of the Supreme Court should alone be appointed to the office of the CJI.
Collegium System for appointment of the Judges:
- The SC collegium is headed by CJI and comprises four other senior most judges of the court.
- The collegium system is the system of appointment and transfer of judges that has evolved through judgments of the SC (Judges Cases), and not by an Act of Parliament or by a provision of the Constitution.
Tenure of Judges of Supreme Court (SC):
The Constitution has not fixed the tenure of Judge of the
Supreme Court. But there are three provisions for this regard –
- He holds office until he attains the age of 65 years.
- He can resign his office by writing to the president.
- He can be removed from his office b the President on the recommendation of the Parliament.
Removal of Judges:
- He/She can be removed by an order of the President only after an address by Parliament has been presented to President.
- This should be supported by a special majority of each House of Parliament.
- Grounds of Removal are two Proved misbehaviour or Incapacity (Article 124(4).
